These Terms and Conditions (“Terms”) govern your use of the Kwickest.com website, mobile application, or other ordering platform (collectively, the “Website”) and the purchase of products (“Products”) from us.

By placing an order through the Website, you agree to be bound by these Terms.

I. Introduction and Our Role

1. Company Details and Contract

1.1. Kwickest.com (“we,” “us,” or “our”) is the retailer and provider of both the Products and the delivery service. 1.2. The legal contract for the supply, purchase, and delivery of all Products is formed directly between you, the Customer, and Kwickest.com. 1.3. Our Service: We offer a late-night local convenience delivery service operating between 4:00 PM and 5:00 AM.

2. Service Coverage

2.1. We only accept orders and provide delivery services to addresses within the following designated postal codes: D18, A94, and A96. 2.2. If you attempt to place an order outside of our service hours or coverage area, your order will not be processed.

3. Your Status

3.1. Capacity and Age: By placing an Order, you warrant that you are at least 18 years old and are legally capable of entering into binding contracts. 3.2. Allergies and Dietary Information: Our Products consist primarily of shelf-stable snacks, soft/energy drinks, hygiene products and other products. If you have any allergies or dietary restrictions, you acknowledge and agree that you are solely responsible for checking the Product packaging or contacting our customer care team before placing your Order.

II. Orders, Pricing, and Payment

4. How to Make an Order

4.1. Compiling Your Order: You may submit your Order by clicking the “Place Order” or similar button on the Website after selecting your Products. 4.2. Order Check: You are solely responsible for ensuring the accuracy of your Order details, delivery address, and contact information before submitting the Order.

5. Order Acceptance and Cancellation

5.1. Contract Formation: We may accept your offer by making a delivery to you. The contract for the sale of the product will be formed when our driver arrives at the delivery address.
5.2. Rejection: We reserve the right to reject any Order at any time such as due to stock limitations, operational constraints, or safety/security concerns without giving any reason and without any liability to you. If an Order is rejected, any pre-authorised payment will be refunded in accordance with Clause 7.3.
5.3. No Cancellation Policy: Due to our commitment to a fast, delivery target, we begin processing orders immediately. You are not entitled to change or cancel your Order once it has been submitted and payment has been authorised.

6. Price and Payment

6.1. Pricing: Prices for Products are as quoted on the Website and include VAT where applicable.
6.2. Delivery Fee: A flat delivery fee will be added to the total amount of your Order.
6.3. Payment Methods: Payment must be made by an accepted credit or debit card through the Website.

III. Delivery and Risk

7. Delivery

7.1. Delivery Time: We aim to complete all deliveries within 30 minutes by bicycle. You acknowledge and agree that this is an estimated target, and neither we nor our delivery personnel guarantee that your Order will be delivered within this time.
7.2. Unsuccessful Delivery: If you are not present at the specified delivery address to receive the Order: * We will make reasonable efforts to contact you. * If we cannot contact you, or if you fail to accept the delivery, the delivery rider may, at their sole discretion, leave the Order at a reasonable location outside, close to the delivery address. * Kwickest.com will not be responsible for the Order, including its quality or safety, after the rider has deemed the delivery successfully completed.
7.3. Refunds for Rejected Orders: If your Order is rejected or cancelled for any reason, any funds “ring-fenced” by your bank or card issuer will be released back into your available balance. This release process is controlled by your bank and may take up to ten (10) working days, and Kwickest.com is not responsible for this delay.

8. Liability for Products and Delivery

8.1. Our Responsibility: As the retailer and delivery provider, Kwickest.com is liable for the quality of the Products and the service we provide, subject to these Terms.
8.2. Limitations: We will not be liable for any failure or delay caused by events outside our reasonable control (“Force Majeure Event”), including but not limited to severe weather conditions, which may impact bicycle-based delivery.

IV. General Terms and Governing Law

9. User-Generated Content

9.1. Reviews: Any feedback, ratings, or reviews you submit regarding our Products or service (“Reviews”) will be considered non-confidential.
9.2. We reserve the right to use, copy, distribute, and publish any Review for commercial or non-commercial purposes.
9.3. You are prohibited from posting or transmitting any content that is unlawful, misleading, contains viruses, or is in breach of any applicable law.

10. Termination

10.1. We may terminate or suspend your right to use the Website and its services immediately if we believe you have breached any of these Terms.
10.2. Misuse, unauthorised, fraudulent, or otherwise suspicious activity on your account is grounds for immediate termination or suspension.

11. Governing Law and Jurisdiction

11.1. These Terms shall be governed by and construed in accordance with the laws of Ireland.
11.2. You can bring legal proceedings in respect of these Terms in the Irish courts.

12. Prohibited uses

You may not use this Site for any of the following purposes: 

1. Disseminating any unlawful, misleading, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
2. Transmitting material that encourages criminal conduct, results in civil liability or otherwise breaches any relevant laws, regulations or codes of practice.
3. Gaining unauthorised access to any computer system.
4. Interfering with any other person’s use of this Site.
5. Breaching any laws concerning the use of public telecommunications networks.
6. Interfering or disrupting networks or websites connected to this Site.
7. Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

13. Indemnities

You will indemnify Kwickest.com against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction, and all sums paid by us as a result of any settlement agreed by us arising out or in connection with:

Any claim by any third party that the use of this Site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice.

Any claim by any third party that the use of this Site by you infringes that third party’s copyright or other intellectual property rights of whatever nature.

Any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of this Site by you.
